Terms of Use

These simple rules help make sure every student’s story is handled with care. Each section starts with the legal terms, followed by a plain-language summary.

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and The Yearbook App, LLC (“The Yearbook,” “we,” “us”). By creating an Account or using the Service, you agree to these Terms, the Privacy Policy, and the Billing Policies.

In plain language: Using The Yearbook means you agree to these rules.

2. Definitions

  • “Service” means The Yearbook website, app, and related services.
  • “School,” “Advisor,” “Account,” “Yearbook Records,” “Community Submission,” and “Submitter” have the meanings given in the Privacy Policy.
  • “Content” means Yearbook Records, Community Submissions, and anything else added to the Service by or for a School.
  • “License” means a paid School-Year License or Monthly Billing plan, as described in the Billing Policies.

3. Eligibility and School Permission

3.1 The Service is for school staff creating a school yearbook. You must be at least 18 years old and have permission from your School to use the Service for that purpose.

3.2 If you accept these Terms for a School, you confirm that you are authorized to do so.

3.3 Keep your password private. You are responsible for activity on your Account. Tell us right away if you think someone has used your Account without permission.

3.4 We do not sign data agreements. The Yearbook App, LLC does not sign school or district data privacy agreements or similar contracts. The reason is simple: the Service is built so that no one at the Company ever views or reviews a school's photos or student information, and the Company will not take on contractual obligations it is not staffed to fulfill. These Terms, the Privacy Policy, and the Billing Policies are the complete agreement. If your School or district requires a signed data agreement, do not use the Service.

In plain language: The Yearbook is for school staff, with the school’s permission. Keep your password to yourself. We don’t sign separate data agreements — these terms are the whole agreement.

4. License Grant

While you follow these Terms and any required License is active, we give you a limited, non-exclusive, non-transferable, revocable right to use the Service for your School’s yearbook. Some features are free. Others need a paid License, as shown in the app and on the Pricing page.

In plain language: You may use The Yearbook for your school’s yearbook.

5. License Restrictions

You agree not to:

  • copy, resell, sublicense, or rent the Service;
  • reverse engineer the Service or try to get its source code, except where the law allows it;
  • get around security, access limits, or paid-feature locks;
  • use automated tools to scrape or overload the Service;
  • use the Service to build a competing product.

In plain language: Please use the app as intended and don’t try to break or copy it.

6. Intellectual Property

The Service, including its software, design, text, and branding, belongs to The Yearbook and is protected by law. These Terms do not give you any ownership in the Service. If you send feedback, we may use it to improve the Service without any obligation to you.

In plain language: The app belongs to us. Your school’s content belongs to your school.

7. School Ownership of Content

7.1 Your School owns the photos, names, and stories you add. We store and display them only so the Service works for you.

7.2 You give us a limited permission to host, store, process, and display Content only to provide the Service to your School. This permission ends when the Content is deleted, apart from backups that age out as the Privacy Policy describes.

7.3 We never sell Content, use it for advertising, or use student photos to train AI models.

8. Advisor Responsibilities

You agree to:

  • upload only photos you have the right to use;
  • follow your School’s photo-release, student-privacy, and records policies;
  • review Community Submissions before adding them to the yearbook;
  • remove a photo when a family or your School asks you to;
  • keep your own copies of anything critical to your printed yearbook.

In plain language: You decide what goes in, and you follow your school’s rules.

9. Community Upload Rules

9.1 Submitters confirm they have permission to share each photo.

9.2 Anyone under 18 needs a parent’s or guardian’s permission.

9.3 Advisors decide what joins the yearbook. A submission does not guarantee a photo will be used.

9.4 Advisors may revoke an upload link at any time.

In plain language: Families share, and advisors decide.

10. Prohibited Uses

You may not use the Service to:

  • harass, bully, or threaten anyone;
  • upload harmful, unlawful, or sexually explicit content;
  • share photos that would embarrass or endanger a student;
  • violate anyone’s privacy or intellectual property rights;
  • upload viruses or harmful code.

We may remove content or suspend Accounts that break these rules.

11. Service Availability

We work hard to keep the Service available and your data safe. The Service may sometimes be unavailable for maintenance, updates, or reasons outside our control. We may change or improve features over time.

12. “As-Is” Disclaimer

To the fullest extent the law allows, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be error-free or uninterrupted.

In plain language: We do our best, but we can’t promise the app will be perfect.

13. Limitation of Liability

13.1 To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.

13.2 Our total liability for any claim related to the Service is limited to the amount your School paid us in the 12 months before the claim.

13.3 Some places do not allow these limits, so they may not fully apply to you.

In plain language: If something goes wrong, our responsibility is limited to what your school paid us in the last year.

14. Indemnification

You agree to defend and hold harmless The Yearbook from claims that arise from Content you upload without the right to do so, from your breach of these Terms, or from your violation of law or school policy.

15. Termination

15.1 You may stop using the Service and delete your Account at any time in Settings. Deleting your Account cancels any active License.

15.2 We may suspend or end access if these Terms are seriously broken, or if we must do so to protect students or follow the law. When we can, we will give notice and a chance to export your data.

15.3 Sections 6, 7, 12, 13, 14, 16, and 17 continue after termination.

16. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. If your School is a public institution, any law that requires a different governing law for public entities applies instead.

17. Dispute Resolution

17.1 Please contact us first. Most concerns can be resolved quickly and informally.

17.2 If we cannot resolve a dispute within 30 days, it will be handled in the state or federal courts located in Maricopa County, Arizona, unless the law applicable to your School requires otherwise.

In plain language: Talk to us first. We’ll do our best to make it right.

18. Integration with Billing Policies

Paid Licenses are covered by the Billing Policies, which include the Subscription Agreement, Renewal Policy, Cancellation Policy, and Refund Policy. The Billing Policies are part of these Terms. If these Terms and the Billing Policies disagree about billing, the Billing Policies apply.

19. Changes to These Terms

We may update these Terms. We will tell you about meaningful changes by email or in the app before they take effect. Continuing to use the Service afterward means you accept the updated Terms.
